1. Scope

These terms apply to all Pakun AI services (audits, assessments, consulting and implementation services) provided to business customers within the meaning of Section 14 of the German Civil Code (BGB). Orders are subject to express confirmation.

2. Scope of services

Services are provided within the relevant service description (offer / email). AI audits are snapshots: AI-system responses vary daily and are not deterministic. Pakun AI owes careful performance of the measurement, not a particular AI ranking or particular citations.

3. Fees and payment

Fees are based on the offer or price list. Payment is made by payment link (Stripe) before services are provided. Prices are net of any VAT due.

3a. Monthly support (subscription)

“Ongoing support and repeat measurement” (€490 per month) is a monthly subscription. The next monthly charge is made automatically through the Stripe subscription unless cancelled in writing no later than 14 days before the end of the current month. Following cancellation, the service ends at the end of the current month. There is no minimum subscription period beyond one month.

3b. Referral programme

For each successful and paid engagement resulting from a referral, Pakun AI pays a one-off €100 reward (a fixed amount, not a general right to a price reduction). It is due after completion of the referred business’s first paid project. Referrals of one’s own businesses and referrals involving certain relationships (close relatives, affiliated businesses) are excluded. Payment is by bank transfer or credit against the referrer’s own project. A legal entitlement arises only once Pakun AI confirms the reward in writing.

4. Timeframes

Stated delivery times (for example, “5–7 business days”) are non-binding estimates. Written deadline agreements take precedence.

5. Results and usage rights

Audit reports and findings are supplied to the client for internal business use. Disclosure to third parties requires consent unless required by law.

6. Warranty and liability

Pakun AI has unlimited liability for intent and gross negligence. Otherwise, liability applies only to breaches of essential contractual obligations and is limited to foreseeable loss typical of the contract. Strict liability under the German Product Liability Act remains unaffected. The statutory warranty period applies.

7. Confidentiality and privacy

Both parties treat accessible information confidentially. Data is processed in accordance with our privacy policy and applicable requirements (GDPR).

8. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for merchants is Berlin. Amendments are valid only in writing. If a provision is invalid, the remainder of the contract remains effective.
